SMS Terms

The terms of the Cloutly review-request text messaging program: who sends the messages, why, how often, and how to get help or opt out.

Program

Program name: Cloutly Review Requests.

Cloutly Co Pty Ltd (ACN 637 155 045) provides review-request software to service businesses such as clinics, salons and gyms. On behalf of a business that uses Cloutly, we send a text message to that business’s customer after a completed purchase or appointment. The message asks the customer to rate their experience and, if they choose, to leave a review. Each message names the business it is sent for.

Who receives messages

Messages go only to existing customers of a business that uses Cloutly. For US mobile numbers, a customer is only texted if they opted in to feedback texts from the business by ticking an optional box when booking or checking out. Customers who don’t tick it are not texted. The business adds its customers to Cloutly through a booking or point-of-sale integration, manual entry, or a file import. Under our Terms and Conditions (clause 4.2), the business must have a lawful basis and any consent required to contact every person it adds.

A business that uses Cloutly to text customers with US mobile numbers must collect consent to feedback texts with its own optional checkbox, not ticked by default and separate from any email, marketing or other consent, wherever it collects the customer’s mobile number, such as an online booking form or a checkout page. The consent must:

  • name the business;
  • cover feedback-request texts from the business, and nothing else: consent to marketing texts must be a separate checkbox;
  • say how often messages are sent;
  • say that message and data rates may apply;
  • say how to opt out, such as replying STOP; and
  • make clear that consent is not required to book or buy.

A booking or point-of-sale system’s built-in SMS opt-in can be used only if it covers these points and is not combined with marketing consent. Where the business writes its own, a short label with a line of small print beneath it works:

Ticking the box is not required to book or buy, and customers who leave it unticked are not texted.

How the opt-in appears on an online booking form, exactly as the customer first sees it: the box is blank and stays blank unless the customer ticks it.

Confirm booking
Illustration. Coastline Physio is a fictional business; the SMS opt-in is its own optional checkbox under the mobile number field. It is never pre-ticked: the customer has to tick it themselves to opt in. Booking works either way, and customers who leave it blank are not texted.

How often

One message per visit. If you leave a review, you will not receive further review requests for that visit. If you do not, you will not be messaged again for at least 90 days, and only after a new visit to the business.

Costs

Message and data rates may apply. Cloutly does not charge you to receive these messages.

Help and opting out

  • Reply STOP to any message to stop receiving messages. You will receive one confirmation and no further messages from that number. Reply START to resubscribe.
  • Reply HELP for help, or email support@cloutly.com.

Carriers are not liable for delayed or undelivered messages.

Privacy

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Mobile numbers may be shared with subcontractors that support our services, such as message delivery and customer service, and with the business that collected them. Text-messaging opt-in data and consent will not be shared with any other third parties. See our Privacy Policy for how we handle personal information.
