For 15 years, as direct neighbors of the London Plaza Food Court and KFC Vacoas, my family and I have been suffering from the consequences of poor urban planning. Building a food court in the heart of a residential zone, where the backyard faces the homes of peaceful and educated citizens, has transformed our neighborhood into a ghetto. This has exposed us to numerous nuisances, including noise pollution and unwelcome disturbances. KFC, in particular, has subjected us to relentless noise issues, which include: 1. Prolonged Use of Pressure Washers Employees frequently operate loud water jet pressure machines for prolonged periods to clean walls and pavements. This often feels like a way to pass the time, as it’s easier to press a button than to serve customers behind the counter. 2. Noisy Maintenance and Renovation Work Maintenance and renovation activities are often carried out at night, using heavy equipment like concrete drills and hammers to break walls. Loud compressors are also used for painting, creating unbearable noise for nearby residents. Despite reaching out to the COO, laisser-aller has prompted us to inform the police. This creates an unnecessary pressure on us and disturbs us from our daily activities in order to contact the police. 3. Employment of Habitual Criminals On one occasion, a known habitual criminal employed by KFC threatened me, leading to police intervention at the London Plaza parking lot. The police prevented a potential assault, yet this individual continued to threaten me outside my gate throughout the night. 4. Unregulated Electric Motors Numerous electric motors, including roof-mounted compressors, run continuously, facing directly toward my house. It is unclear whether proper permits were obtained for these installations. The late Mayor of Vacoas-Phoenix publicly stated on radio, that neighbors must be notified before installing such equipment. Furthermore, the Office of the Ombudsman confirmed that, aside from one tenant of the food court, no permits for motor installations exist. All of this occurs in what is supposed to be a RESIDENTIAL zone. 5. Disturbance from Employee Behavior Conversations in KFC’s backyard, often filled with offensive local swear words, can be clearly heard in the early evening. Additionally, the clanging of utensils during cleaning—usually after 10:00 PM—further disturbs the peace. 6. Smoking Violations Mauritius became a Party to the WHO Framework Convention on Tobacco Control on February 27, 2005. However, the area behind KFC is littered with cigarette butts because employees blatantly smoke at the workplace. Smoking is strictly prohibited in all indoor workplaces, including areas where food is prepared and utensils are cleaned. The Public Health (Restrictions on Tobacco Products) Regulations 2022 enforce a comprehensive smoking ban in both indoor public places and many outdoor spaces, yet these rules are blatantly ignored.
